चार्जशीट दायर करने के बाद भी रद्द हो सकती है FIR : सुप्रीम कोर्ट

सुप्रीम कोर्ट ने एक महत्वपूर्ण फैसले में व्यवस्था दी है कि चार्जशीट दायर होने के बाद भी आरोपी एफआईआर रद्द करवाने के लिए सीआरपीसी की धारा 482 के तहत उच्च अदालत में याचिका दे सकता है। अब तक कानून यही है कि किसी आपराधिक मामले में चार्जशीट दायर हो जाने पर उसमें धारा 482 के तहत एफआईआर रद्द करने की याचिका स्वीकार्य नहीं होती, लेकिन कोर्ट के इस फैसले से आपराधिक न्यायशास्त्र की स्थिति में अभियुक्तों के पक्ष में बड़ा बदलाव आ गया है। 

जस्टिस एसए बोब्डे और एल नागेश्वर राव की पीठ ने यह फैसला देते हुए कहा कि यह मानना अन्याय होगा कि किसी व्यक्ति के खिलाफ कार्यवाही में एफआईआर की स्टेज पर ही हस्तक्षेप किया जा सकता है। पीठ ने कहा कि हाईकोर्ट एफआईआर रद्द करने की याचिका को सुन सकता था। यहां तक कि इस याचिका के लंबित रहते यदि चार्जशीट दायर भी हो गई है तो भी इसे सुना जा सकता है।

चार्जशीट के बाद दुरुपयोग और बढ़ जाएगा  

कोर्ट ने फैसले में कहा कि धारा 482 में यह कहीं नहीं है, जिसमें कोर्ट को कानून का दुरुपयोग या अन्याय होने से रोकने के लिए सिर्फ एफआईआर की स्टेज पर ही प्रतिबंधित किया हो। यह कानून का स्थापित सिद्धांत है कि हाईकोर्ट धारा 482 के तहत क्षेत्राधिकार का प्रयोग कर सकता है। यहां तक कि हाईकोर्ट इस कार्यवाही को ट्रायल कोर्ट में डिस्चार्ज अर्जी लंबित होने पर भी जारी रख सकता है। कोर्ट ने कहा कि यह मानना अन्याय होगा कि अभियुक्त के खिलाफ चार्जशीट दायर हो चुकी है और अब उसकी रिपोर्ट रद्द करने की याचिका नहीं सुनी जा सकती। इसके उलट एफआईआर के कारण प्रक्रिया का दुरुपयोग उस समय और ज्यादा बढ़ जाएगा, जब यह जांच के बाद चार्जशीट में तब्दील हो जाएगी। इसमें कोई शक नहीं है कि अन्याय तथा प्रक्रिया का दुरुपयोग रोकने की शक्ति हर कोर्ट को दी गई है। 

कोई अपराध साबित नहीं होता

यह फैसला देते हुए सुप्रीम कोर्ट ने आनंद मोहता के खिलाफ प्रकरण में कहा कि यह मामला दीवानी प्रकृति का है इसमें कहीं कोई अपराध साबित नहीं होता। हम मानते हैं कि एक करोड़ रुपये की सुरक्षा राशि को अभियुक्त द्वारा हड़प लेना विशुद्ध रूप से दीवानी मामला है। हम यह भी देख रहे हैं कि इस मामले में शिकायतकर्ता ने इस राशि को वापस लेने के लिए एफआईआर दर्ज करने के अलावा कोई और प्रयास नहीं किए। इससे साफ है कि यह अभियोजन दुर्भावनापूर्ण, न टिकने योग्य और अभियुक्त को परेशान करने की नीयत से किया गया है।

चार्जशीट दायर करने के बाद भी रद्द हो सकती है FIR : सुप्रीम कोर्ट

सुप्रीम कोर्ट ने एक महत्वपूर्ण फैसले में व्यवस्था दी है कि चार्जशीट दायर होने के बाद भी आरोपी एफआईआर रद्द करवाने के लिए सीआरपीसी की धारा 482 के तहत उच्च अदालत में याचिका दे सकता है। अब तक कानून यही है कि किसी आपराधिक मामले में चार्जशीट दायर हो जाने पर उसमें धारा 482 के तहत एफआईआर रद्द करने की याचिका स्वीकार्य नहीं होती, लेकिन कोर्ट के इस फैसले से आपराधिक न्यायशास्त्र की स्थिति में अभियुक्तों के पक्ष में बड़ा बदलाव आ गया है। 

जस्टिस एसए बोब्डे और एल नागेश्वर राव की पीठ ने यह फैसला देते हुए कहा कि यह मानना अन्याय होगा कि किसी व्यक्ति के खिलाफ कार्यवाही में एफआईआर की स्टेज पर ही हस्तक्षेप किया जा सकता है। पीठ ने कहा कि हाईकोर्टएफआईआर रद्द करने की याचिका को सुन सकता था। यहां तक कि इस याचिका के लंबित रहते यदि चार्जशीट दायर भी हो गई है तो भी इसे सुना जा सकता है।

यह फैसला देते हुए सुप्रीम कोर्ट ने आनंद मोहता के खिलाफ प्रकरण में कहा कि यह मामला दीवानी प्रकृति का है इसमें कहीं कोई अपराध साबित नहीं होता। हम मानते हैं कि एक करोड़ रुपये की सुरक्षा राशि को अभियुक्त द्वारा हड़प लेना विशुद्ध रूप से दीवानी मामला है। हम यह भी देख रहे हैं कि इस मामले में शिकायतकर्ता ने इस राशि को वापस लेने के लिए एफआईआर दर्ज करने के अलावा कोई और प्रयास नहींकिए। इससे साफ है कि यह अभियोजन दुर्भावनापूर्ण, न टिकने योग्य और अभियुक्त को परेशान करने की नीयत से किया गया है। 

क्या है मामला 
मोहता ने एक संपत्ति विकसित करने के लिए बिल्डर से अनुबंध किया था, लेकिन बाईलाज में पता लगा कि संपत्ति को गगनचुंबी इमारत नहीं बनाया जा सकता, क्योंकि यह लुटियन जोन में है। इसके बाद उसने बिल्डर को लिखा कि वह संपत्ति विकसित नहीं करवाना चाहता, लेकिन उसने बिल्डर से लिए एक करोड़ रुपये की सुरक्षा राशि नहीं लौटाई। बिल्डर ने एफआईआर दर्ज करवा दी। इसे रद्द करवाने के लिए मोहता दिल्ली हाईकोर्ट गए, लेकिन कोर्ट ने कहा कि मामले में प्रारंभिक जांच चल रही है और याचिका रद्द कर दी। इसके बाद वह सुप्रीम कोर्ट आए, लेकिन तब तक पुलिस ने चार्जशीट दायर कर दी। कोर्ट में कहा गया कि चार्जशीट दायर होने के बाद एफआईआर रद्द करने की याचिका नहीं सुनी जा सकती।

खरसिया (रायगढ़) राष्ट्रीय अपराध जांच ब्यूरो द्वारा वीर जवानों एवं अमर शहीदों का शौर्य-सम्मान समारोह स्थानीय लखीराम आडिटोरियम में आयोजित किया गया। वतन के रक्षा में अपने प्राणों की आहुति देने वाले शहीदों एवं के पहरेदारों के सम्मान में प्रातः 11:00 बजे विश्रामगृह से देशभक्ति के उत्साहपूर्ण गीतों के साथ रैली निकाली गई, जो प्रमुख मार्गो से होती हुई कार्यक्रम स्थल पहुंची। यह गरिमामय कार्यक्रम राष्ट्रीय अपराध जाँच ब्यूरो के प्रदेश निदेशक श्री अनंतराम साहू एवं सह निदेशक श्री उसतरम पटेल की अध्यक्षता में संपन्न हुआ। वहीं विशिष्ट अतिथि के रूप में जिले के संवेदनशील पुलिस कप्तान दीपक झा उपस्थित रहे।

राष्ट्रीय अपराध जांच ब्यूरो (NCIB) छत्तीसगढ़ के तत्वाधान में यह कार्यक्रम आयोजित किया गया जिसमें विशिष्ट अतिथि पुलिस कप्तान दीपक झा ने सभा को संबोधित करते हुए कहा कि सभी देशवासियों को सैनिकों का सम्मान करना चाहिए। साथ हि देशभक्ति के पर्व 15 अगस्त का अवसर चल रहा है, ऐसे में जगह-जगह देशभक्ति गीतों के कार्यक्रम भी आयोजित करने चाहिए। वहीं जहां भी हमें अपने वतन के प्रहरी मिलते हैं, तो उनका सम्मान कर उनके प्रति कृतज्ञता प्रदर्शित करनी चाहिए। पुलिस कप्तान ने कहा कि वे अपने स्तर से सैनिक तथा सैनिक परिवारों द्वारा प्राप्त शिकायतों को अविलम्ब निस्तारण हेतु दृढ़ संकल्पित है।

राष्ट्रीय अपराध जाँच ब्यूरो के डायरेक्टर जनरल श्री सुरेश शुक्ल ने सैनिको को सम्बोधित करते हुए कहा की NCIB सदैव सैनिको एवं सैनिक परिवारों के सेवा में तत्पर है। हमारी संस्था द्वारा सैनिकों को उचित सम्मान देने हेतु जनपद स्तरीय सैनिक शौर्य सम्मान कार्यक्रम का आयोजन करके शहीद सैनिक परिवारों एवं वर्तमान एवं पूर्व सैनिको को सम्मानित किया जा रहा है।

राष्ट्रीय अपराध जांच ब्यूरो द्वारा आयोजित इस कार्यक्रम में पुलिस कप्तान श्री दीपक झा द्वारा लगभग 50 पूर्व एवं वर्तमान सैनिको के साथ शहीद सैनिक परिवार को प्रसस्तिपत्र प्रदान करके सम्मानित किया गया।

इस कार्यक्रम में स्थानीय लोगों, सैनिक, पूर्व सैनिक एवं शहीद सैनिक परिवारजनों के अलावा जिला में कार्यरत राष्ट्रीय अपराध जाँच ब्यूरो के कार्यकर्ताओ समेत हजारो लोग मौजूद थे।

नई दिल्ली: प्रधानमंत्री नरेंद्र मोदी ने रविवार को नीति आयोग की बैठक में आंध्रप्रदेश और बिहार जैसे राज्यों को विशेष दर्जा प्रदान करने की मांग पर कहा कि केंद्र सरकार राज्यों के बंटवारे के समय तय किए गए वैधानिक प्रावधानों को अक्षरश: पालन करने को प्रतिबद्ध है. नीति आयोग की प्रबंध समिति की चौथी बैठक के बाद संवददाताओं को बैठक की जानकारी देते हुए आयोग के उपाध्यक्ष राजीव कुमार ने कहा कि मुख्यमंत्रियों की बैठक को संबोधित करते हुए प्रधानमंत्री नरेंद्र मोदी ने कुछ राज्यों द्वारा विशेष दर्जा की मांग पर केंद्र सरकार का रुख स्पष्ट किया.

आंध्रप्रदेश के मुख्यमंत्री चंद्रबाबू नायडू ने राज्य को विशेष केटेगरी का दर्जा प्रदान करने की अपनी लंबित मांग का मुद्दा उठाया जिसे बिहार के मुख्यमंत्री नीतीश कुमार ने समर्थन दिया. इस पर प्रधानमंत्री ने उन्हें वैधानिक प्रावधानों का पालन करने का आश्वासन दिया.

राजीव कुमार ने बताया, “कुछ राज्यों ने विशेष दर्जा का मुद्दा उठाया. बातचीत वैधानिक प्रावधानों पर केंद्रित थी, जोकि राज्यों के बंटवारे के समय तय किए गए थे. प्रधानमंत्री ने कहा कि केंद्र सरकार उन प्रावधानों का अनुपालन अक्षरश: करने को प्रतिबद्ध है.”

राजीव कुमार ने कहा, “विस्तृत योजना तैयार की जा रही है और एमएसपी 1.5 गुना बढ़ाने के प्रधानमंत्री के वादे को पूरा करने के लिए राज्यों को कई विकल्प प्रदान किए जाएंगे.”

कुमार ने कहा कि नीति आयोग (पूर्व में योजना आयोग) के अध्यक्ष प्रधानमंत्री ने किसानों के मसलों की जांच-पड़ताल के लिए एक समिति का गठन करने का निर्देश दिया है. नीति आयोग के उपाध्यक्ष ने बताया कि विचार-विमर्श के दौरान राज्यों को अपने सकल घरेलू उत्पाद (जीडीपी) का लक्ष्य तय करने का सुझाव भी दिया गया.

विपक्ष ने की मांग- 50 फीसदी चुनाव EVM और आधा बैलेट पेपर से होनई दिल्ली : विपक्षी दलों ने हाल ही में उपचुनावों के दौरान ईवीएम में कथित गड़बड़ी के हवाले से आधा चुनाव ईवीएम से और आधा मतपत्र से कराने की मांग उठाई है. राज्यसभा में नेता प्रतिपक्ष गुलामनबी आजाद की अगुवाई में विपक्षी दल के नेताओं का प्रतिनिधिमंडल आज शाम चुनाव आयोग से यह मांग करेगा.

चुनाव आयोग के समक्ष मुद्दा उठाएगा विपक्ष

आजाद की अध्यक्षता में आज जनता दल यू, समाजवादी पार्टी और तृणमूल कांग्रेस सहित अन्य विपक्षी दल के नेताओं की बैठक में ईवीएम की गड़बड़ी के मुद्दे को एकजुट होकर चुनाव आयोग के समक्ष उठाने का निर्णय किया गया. बैठक में मौजूद एक नेता ने बताया कि इस साल के अंत तक गुजरात और हिमाचल प्रदेश में होने वाले विधानसभा चुनाव की आधी सीटों पर ईवीएम से और आधी सीटों पर मतपत्र से मतदान कराने की आयोग से मांग करने पर बैठक में सहमति बनी है.

ईवीएम से छेड़छाड़ का विपक्ष का है आरोप

ऐसा होने पर ईवीएम में छेड़छाड़ की लगातार बढ़ रही शिकायतों से समूची निर्वाचन प्रणाली पर उठ रही शंकाओं का भी निराकरण हो सकेगा और मशीनों में छेड़छाड़ नहीं हो सकने के चुनाव आयोग के दावे की पुष्टि हो जायेगी. विपक्षी दल एकजुट होकर भविष्य में होने वाले सभी चुनावों में पेपर ट्रेल मशीन (वीवीपीएटी) से चुनाव कराने की मांग कर रहे हैं. जबकि कांग्रेस ईवीएम में कथित छेड़छाड़ के मद्देजनर मशीन के बजाय मतपत्र के इस्तेमाल पर जोर दे रही है.

विपक्ष के नेता उठाएंगे मु्द्दा

एक नेता ने कहा, ‘इस व्यवस्था को बनाए रखने के लिए आवश्यक किसी भी बुनियादी सिद्धांत के उल्लंघन पर तत्काल एवं गंभीरता के साथ कार्रवाई किए जाने की आवश्यकता है.’ संसद भवन परिसर स्थित आजाद के कार्यालय में हुई बैठक में कांग्रेस नेताओं अहमद पटेल, आनंद शर्मा, कपिल सिब्बल और विवेक तनखा के अलावा जदयू नेता अली अनवर अंसारी, तृणमूल नेता सुखेंदु शेखर रॉय, बसपा नेता सतीश मिश्रा और सपा नेता नीरज शेखर मौजूद थे. राकांपा नेता मजीद मेमन, माकपा नेता डी राजा और राजद नेता जे पी नारायण यादव भी बैठक में मौजूद थे. सभी नेताओं ने इस मुद्दे को मजबूती से चुनाव आयोग के समक्ष उठाने का निर्णय लिया है.

कोलकाता : देश के मुख्य निर्वाचन आयुक्त ओपी रावत ने चुनावों के लिए बैलेट पेपर को वापस लाने की सभी संभावनाओं को खारिज करते हुए कहा कि ईवीएम को बलि का बकरा बनाया जा रहा है, क्योंकि मशीनें बोल नहीं सकतीं और राजनीतिक दलों को अपनी हार के लिए किसी न किसी को जिम्मदार ठहराने की जरूरत होती है. मर्चेट्स चेंबर ऑफ कामर्स एंड इंडस्ट्री द्वारा आयोजित ‘निर्वाचन ईमानदारी और चुनावों में धन की भूमिका’ पर आयोजित एक इंटरएक्टिव सत्र में यहां रावत ने कहा, “प्रणाली की ईमानदारी के बारे में वास्तव में कुछ भी नहीं है, हालांकि जब भी इस मुद्दे पर सवाल उठते हैं, हम स्पष्टीकरण देते हैं.”

उन्होंने कहा कि चुनाव आयोग ने पिछली जुलाई को सर्वदलीय बैठक में घोषित किया था कि आगे से सभी चुनाव वोटर वेरिफियेबल पेपर ऑडिट ट्रेल (वीवीपैट) मशीनों के साथ ईवीएम का प्रयोग करके किए जाएंगे. उन्होंने कहा कि मतदान प्रक्रिया में पारदर्शिता और विश्वसनीयता बढ़ाने के लिए ईवीएम के साथ वीवीपैट का प्रयोग भी किया जाएगा.

रावत ने कहा कि राजनीतिक दलों द्वारा ईवीएम को आसानी से बलि का बकरा बना दिया जाता है, क्योंकि वह बोल नहीं सकती और राजनीतिक दलों को अपनी हार का ठीकरा फोड़ने के लिए किसी न किसी चीज की जरूरत होती है.

डायरेक्टर शशांक घोष ने फिल्म वैसा भी होता है- 2, क्विक गन मुरुगन, मुंबई कटिंग, खूबसूरत फिल्में डायरेक्ट की हैं. अब उन्होंने करीना कपूर खान, सोनम कपूर, शिखा तलसानिया, स्वरा भास्कर के साथ एक एडल्ट कॉमेडी ड्रामा बनायी है.  कैसी है ये फिल्म आइए समीक्षा करते हैं.

कहानी

फिल्म की कहानी दिल्ली के एक ही स्कूल में पढ़ने वाली चार लड़कियों से शुरू होती है. स्कूल से निकलने के 10 साल बाद चारों दोस्त यानि अवनी (सोनम कपूर), साक्षी सोनी (स्वरा भास्कर), मीरा (शिखा तलसानिया) और कालिंदी पुरी (करीना कपूर खान) अलग-अलग स्थिति में होती हैं. साक्षी सोनी ने शादी तो कर ली लेकिन लंदन जाकर अपने पति विनीत से तलाक लेकर वापस दिल्ली आ जाती है. वहीं मीरा अपने पिता की मंजूरी के बिना अमेरिका के रहने वाले जॉन से शादी कर लेती है जिनका बेटा कबीर होता है. तीसरी तरफ दिल्ली में ही रहकर अवनी ने वकालत की पढ़ाई की और मैट्रिमोनियल वकील बन गई हैं. वहीं कालिंदी की ऑस्ट्रेलिया में पढ़ाई के दौरान ऋषभ (सुमित व्यास) से मुलाकात होती है और दोनों शादी का प्लान करते हैं. इसके लिए वे ऑस्ट्रेलिया से दिल्ली चले आते हैं. जब कालिंदी की शादी की खबर उसकी तीनों दोस्तों को मिलती है तो वे दिल्ली आकर एक साथ कालिंदी की शादी में शरीक होने के लिए तैयार होती है. इन चारों दोस्तों की जिंदगी में तरह-तरह के उतार चढ़ाव देखने को मिलते हैं. जब ये चारों दोस्त एक साथ कालिंदी की शादी के लिए मिलते हैं तो बहुत सारी कहानियां सामने आती हैं. कई मोड़ भी दिखाई देते हैं और आखिर में एक रिजल्ट निकलता है जिसे जानने के लिए आपको फिल्म देखनी पड़ेगी.

जानिए आखिर फिल्म को क्यों देख सकते हैं

फिल्म की कहानी चार दोस्तों की है जो आधुनिक युग में जिंदगी को पूरी तरह से जीने की कोशिश करते हैं. फिल्म की लिखावट बढ़िया है साथ ही साथ जिस तरह से कहानी आगे बढ़ती है पता ही नहीं चलता है कि इंटरवल कब आ गया. करीना कपूर खान, स्वरा भास्कर, सोनम कपूर और शिखा तलसानिया पूरी तरह से अपने किरदारों के साथ न्याय करती हैं. करीना होने वाली बहू के रूप में नजर आती हैं. फिल्म में कई ऐसे वन लाइनर्स हैं जो आपको हंसने पर मजबूर करते हैं. वही डायरेक्शन, सिनेमेटोग्राफी, लोकेशन आर्ट के साथ कास्टिंग भी बेहतरीन है. फिल्म में बोले जाने वाला लहजा ज्यादातर एडल्ट है जिसकी वजह से फिल्म को एडल्ट सर्टिफिकेट मिला है.

कमजोर कड़ियां

फिल्म का सेकंड हाफ काफी धीरे धीरे चलता है और कई जगह ऐसे भी पल आते हैं जब लगता है कि कहानी खत्म हो जानी चाहिए थी. पर ऐसा हो नहीं पाता, तो कह सकते हैं कि फिल्म की एडिटिंग साफ होनी बहुत जरूरी थी. ”तेरी पप्पी ले लूं” वाले गीत के अलावा कोई भी गाना फिल्मांकन के दौरान आकर्षित कर पाने में असमर्थ दिखाई देता है. फिल्म का अंत और बेहतर हो सकता था खासतौर से क्लाइमैक्स का पार्ट.

बॉक्स ऑफिस

फिल्म का बजट लगभग 30 करोड़ रुपए बताया जा रहा है. ट्रेड पंडितों की मानें तो इस फिल्म को एक अच्छा वीकेंड मिलने की संभावना है. हालांकि एडल्ट सर्टिफिकेट होने के कारण एक खास तरह का तबका फिल्म को देख पाने में असमर्थ होने वाला है.
